I quoted a fact (rational and valid) to argue your assumptions. I never even claimed to know what USCIS would do and how they would present the data. It was you who presented a theory to justify that we should not go with any change in the spill over. I want to know why you dont want EB3I not to proceed with this measure. Is it because you believe it will take away numbers from EB2 or EB3I is doomed with plenty of cases and any amount will not make any changes. I believe its perhaps the earlier than the later. See, we all have our needs and we all want to look for ourselves first (including you and me). Its basic human nature. We all can generate obfuscatory facts to push our agenda. But at the end does it justify the means ?

Now yes I agree a congress man can ask like how come I see Eb3 app from 2001 pending with you since 2001. Which means 8+ years. With Spillover to Eb3 the dates max go to 2002 so the question would be app pending for 7+ years

Is this done before you apply for after you apply for I-485??..I called one of the doctor and they said that once you apply uscis will direct you to get the tests done...is this true??..

just notice that starting April 01... the form need to be filed online and should be printed.

I totally agree with you.Couple of days back my lawyer informed us saying she might be able to file our case only in 2nd week of July & definetely not before that..Today she replies back saying that shez going to file our case by this weekend.:D :D :D
Most of the law firms are aware of the possibility of numbers being unavailabe in mid-july and they have started to speed up the work. For e.g me and my spouse are being represented separately by Fragomen but at two different locations. The one at Santa Clara has confirmed that they will send the AOS appls TODAY, June 29th 2007. No news from the other location in San Francisco but I know they are working with a high priority on AOS applications.
Hope that helps some folks in this forum.....

Both in the job advertisements and Form9089, it is said: minimum of master degree or alternate of bachelor degree plus 2 years' experience.
The LC has been approved in the August of last year, I-140 (EB2) has been filed thereafter, still pending.
How do we file a new application for Eb3 since the original LC has been filed in the last EB2 application?
Is there a way to file an amendment of the pending EB2 to EB3? In this case, can we hire a new lawyer?
Some people has got a RFE, but some just got denied directly, so I am worried.

I remember I read somewhere that if we file a new application with request of a duplication of LC, then we cannot file I-140 and I-485 concurrently. the weired part is no email even though I have "Y" in the settings.. I just happened to check the status online and have the below message for spouse and I

all the studies by economists, investment experts, psychologists, etc for the last several decades clearly showed that for 99% of the people day trading makes them lose all their money. it is highly addictive and on an average everbody loses their savings. legally it is another style of trading and there are no consequences whether you are on J1, H1B, on EAD or a citizen! (ofcourse if somebody knows which stock is going to be up/down and exactly when, he can make a lot of money (better call him a prophet than a day trader/pattern trader).

Did any one of you have two different A#s (one on 140 and other on 485)?
I have two different A #s and in when I applied for AP and EAD, I had used the one on 485 and both were approved.

I am a new member on IV. Haven't contributed, haven't send flowers or thank you cards, haven't volunteered for anything. In fact, I had not even heard of IV up until a month or so back.
However, as I read about the IV efforts in response to the July fiasco, I realised there are a lot of people out here on IV who are doing a tremendous amount of work, work that affects me as an individual positively.
At the last minute, I decided to drive down from NJ. My wife has never ever been on any immigration forum. But she was all for it. We thought it would be too late to get on the NJ bus and drove down.
ME AND MY WIFE ARE VERY PROUD OF IV AND EVERYONE ELSE THAT MADE IT TO DC. IT WAS WELL WORTH THE EFFORT!!!!
For the first time in my life, I have stood up for anything. I am from India and I hate to say it but for far too long, most Indians I know have been shy/meek/lazy about standing up for what we believe in.
Hats off to all the IV volunteers, people who came in and worked over the weekend, people especially who flew into DC, people who came with their kids!!!
PS: Disappointed in my fellow East Coast ppl for no turning up in more numbers
