Howdy,
You cannot file for EAD or AP unless your get your I-485 receipt (A copy of the receipt notice needs to be included in the EAD and AP application). The EAD and AP should go to the same service center as your I-485 application. The address will be listed on your I-485 receipt notice. Pretty straight forward, you can do it yourself, do not pay a lawyer for preparing these documents. Good luck.

Dear Friends at forum:
My husband was an Asylee (approved asylum) when he got married to me. But he got the Green card through me. I am a US citizen. Now he wants to apply for Citizenship through me.
when we applied for his Green card he had to renew his passport of his country of citizenship. it was one of the requirements. That country of citizenship was obviously also the county of his persecution. there was absolutely no issue about it at the time of his Green card interview.
But could it be a problem for citizenship interview?
He never traveled to his country of citizenship nor to any other place. He has never left USA ever since he came here. Does his asylum case will again surface at the time of citizenship even when he is applying for citizenship through me?My understanding is that the asylum thing is no more the issue if he got the GC through me??
Your advice, input and suggestions will be highly appreciated.

:mad:I have another query and thats is i have a a far related cousin and her husband is on l1 visa . now my query is what visa is she on and what visa is her daughter on who was born here few months bak . also how shud she apply for a passport for this kid . is this kid an american citizen and also how to go about passport for the kid and also is it required to apply for visa for the kid to travel to India . Another serious issue she is been illtreated by her husband and how should she report this matter to the local police here .

I�m in EB2 and My I-140 was approved September 2008 through Employer A. And I got laid off on November 2009 from EMP A, within 15 days I joined another Employer B. As per policy, employer B is not going to file GC for me. Already I spend 5 years on my H1B. I check with EMP A�s HR dept, they will not revoke my I-140 and H1B. I know AC21 is one of the options to transfer (Portability) my PD to Emp B after apply I-485.
It would be great if I get answer the below my Question:
1. If my PD is current, Will I eligible to apply I-485 using Employer A I-140 approved?
2. What are the documents needed from employer A, if I want apply I-485?
3. All my friends telling me, I can apply I-485, Is it true?

No you cannot apply I485 in company B. when your PD is current if you go back to your Company A , then company A can file I485.

No you cannot apply I485 in company B. when your PD is current if you go back to your Company A , then company A can file I485.

I think at this pace, it should be for the grandchild!!!!!!
We can write a will and put our priority date in it !!, but I dont think in 25 years from now(assuming we live that long) the US green card will hold any value ;)

You must have I94 showing H1B classification and validity dates to change status to H1. You can travel and re-enter with a H1 visa stamp and obtain h1 status. Please check with the company attorney,

Thanks fromnaija, If she maintains any non-immigrant visa she can be added without any 'follow-to-join' petetion right i.e., she can be added to my 485 just like the normal process when my PD becomes current.

So it looks like I have 2 independent questions:
1. Can an H1B be transferred to a new company once the H1B holder is in their 6+ year?
2. Can one port their EB3 case to EB2 with a new employer?
After reading around in forums, the answer for question 2 seems to be Yes and with some successful examples.
What is still not clear is questions one.
Any help please?

Hello,
I spoke to my lawyer today and she made it very clear that it is ILLEGAL to file more than one I-485 for one applicant (from 2 diff companies). USCIS will immediately ask you to make a choice.
THought I should share this information
yes, thats because when filing I-485 you are 'promising' to join that company when you get your GC. How can you promise that to two companies at the same time.
However could you ask about being primary applicant on one petition and secondary on another (cases where both spouses are working, they can file two AOS and if either spouse decides to stop working for some reason the other application continues, the first can be withdrawn). This one is a grey area. Not illegal, but apparently at some point USCIS will ask you to pick one of the two. In this current mess where some companies/lawyers are promising to file, but may not do so in the end, better to give both choices a good shot, and hope atleast one gets through.

. My company people told me that they would be mailing the h1 transfer application on april 24. And hence i can join on April 28. So i joined and started working from them. i trusted my company and never asked for copy of receipt notice or case number. Few months later, i got H1b approval. Hence never thought there was any problem, until recently when i realized that Receipt Date on the H1b approval notice is May 15.
This difference b/w my actual joining date i.e. April 28 and Receipt Date on H1b Notice i.e. May 15 is causing the concern
Any advise in this regard is appreciated.
