I have my 140 approved and my wife is on F1. How can I proceed with filing 485? (since the dates are current). I am thinking that my wife need to be on H4 before I file for 485.
Will appreciate if anyone has had similar experience and is willing to share.

In my job search (banking and finance jobs) there is this one question i come across on each and every job application-
"Do you now or will you in the future require sponsorship to legally work in the united states?"
and options to tick on the form are 'yes' or 'no' with no space for explanation.
So i mark 'yes' and i guess thats where my job applications get stuck.
Should I answer yes or no, since i am on L2 (visa valid for next 2 years) and currently have 2 years Employment Authorisation (EAD) where i can work for any employer in the United States ?
I understand that companies ask this question because some of them are not allowed/ do not have a policy to sponsor visas.
I want to know whether i am legally required to say 'yes' beacuse i am on L2 ( since after 2 years, my visa renewal depends on whether or not my spouse's L1 is renewed)
OR
Do I still have a choice to say 'no' since my visa renewal gets done if my husband's gets done or i manage it on my own through a consultant... and the company i will join in both cases does not have to sponsor or pay for my visa either now or in the future.
I do not want to misrepresent any information and get thrown out of the organisation after i join, nor do I want to lose out on opportunities because of answering this question wrongly.
(There is a separate question that asks if i am legally allowed to work in the US and i answer 'yes' to that since i have an EAD)

I am assuming you are talking about a new H1 that is subject to the 2009 - 2010 cap of 65K. You can file it anytime as long as H1 numbers are available. You can even file for a H1 in Sept. 2010 (that is subject to the 2009 - 2010 cap) if a visa number is available from the 2009 - 2010 quota (not sure if your job has to start before Oct. 2010 to qualify for a H1 subject to the 2009 - 2010 cap though).

Whats the cost of filing a motion to reopen the case 485 if wrongly rejected(either due to using AC21...). I mean lawyer fees + other fees.

Hi,
My wife's 485 is rejected with the following reason "The application/petition was filed on the outdated version of this form". The rejection notice has a receive date of July 1st 2010 and a LIN number. Now the problem-
My 485 was approved on July 8th, 2010 and I received a "Welcome to USA" notice on July 12th. My H1 has expired on July 14th, 2010 along with wife's H4 and our I-94's. We applied for both the H extensions in may. Now if we resubmit the 485 with the new application will the USCIS honor the July 1st receive date?
My main concern is on her status, any input will be greatly appreciated.

I assume you are concerned about your wife's status so you are specifically asking if USCIS would consider July 1st RD. Now if you file again they will not consider the July 1st RD. They will stamp the actual date that they receive. Don't worry about that. Your wife is covered by the H1/H4 extension filing, have you received the receipts for the H extension filings? I assume you would have, it is almost 2 months now. Don't worry your wife's status is all valid.
Stay cool and apply for I-485 for your wife ASAP.

I did not face this problem because i had a physical Birth Certificate here at US and i Notarized it by American Notary ( Bank of America ) before sending for 485 last July 07
Now for my wife the birth Certificate is physically at India - my father in law is feeling nervous to send the Original by Post - you know how tough it is to get another original BC at India unlike USA where my son has 4-5 original BC for 50 bucks :)
So i was wondering if a Notarization from India would work for 485 purpose ?

this is an attorney question. also this forum is for employment based green card issues. please check with ur attorney.

Obtained conditional residency, the temporary green card, then forgot to apply to remove conditions. So re-applied for green card, and was granted. The parties have been married 5 years. Will the initial 2 years spent as a conditional resident count towards the 3 years for the citizenship? Again, I want to stress out that after the initial 2 years in conditional permanent residency, forgot to remove conditions, and a new application for green card was needed. However this time the permanent green card was given. Or will she have to wait another 3 years from now on with the permanent green card until applying for the citizenship?
