According to TRAC (http://trac.syr.edu/immigration/reports/240/), Justice Department data show that Immigration Judges are declining substantially fewer requests for asylum. Denial rates have reached the lowest level in the last quarter of a century.
Twenty five years ago, in FY 1986, almost nine out of ten (89%) of the asylum requests in the Immigration Courts were denied. While the annual rates have gone up and down during the ensuing years, only half (50%) of the requests were denied during the first nine months of FY 2010 � a record low.
One factor contributing to the improved success of the asylum seekers is that a higher proportion of the total are represented by counsel. It must be noted, however, that the number of those seeking asylum in court proceedings has fallen.

I am on H1-B, and about to apply for I140.
My wife has recently got a F1 visa (and her H4 visa has been left valid).
I am applying for I140. Is it ok to mention her name on my I140 as my spouse?

Your wife's H4 is no longer valid since she switched to F1. You cannot hold non-immigrant status in two different classification at the same time. However, I think it is okay and even expedient that you mention her in your I-140.

I am applying for a green card and my lawyer sent me a case number starting with an A and in the format : A-#####-##### for my PERM.
I tried http://pds.pbls.doleta.gov/ but it does not accept case numbers starting with "A".
Can you please tell me where I can go to look at the status of this application?

I have stamped from Canada 3 times before. without any issue.
I do not know the situation today. If you have all the required documents ready
and You attorney has sent a copy of your H1 extension to PIMS office at Kentucky
(For all extension petition this is required) You can stamp at Canadian US consulate
without much issues. If PIMS is not updated then you have to be ready to stay at Canada
for 1 to 3 months. so be careful before taking decisions, especially nowadays.This is my understanding.
Same thing at Indian consulates. I
f the rules have changed Please enlighten me the folks who knows about it.

If a College fresh guy gets Rs 6,00,000 / yr at bangalore what will be the salary of a 10yr experienced developer 5 years down the line when the talents will move back ?
In fact I�m sure 10yr experienced can immediately mandate a salary of Rs 30,00,000 /yr at Bgl �. You will save almost the same that you are saving here.

My wife and I both work for the same company and my PD date is 1 year behind my wifes. But she was born in Germany though she is currently an Indian citizen. Now that the ROW category has moved passed her PD's date (Nov 6th 2002), we plan to file under the ROW category using the Cross Chargability rules. Does anybody have any experience filing under this rule? We have her birth certificate (translated into English from German etc) and our lawyers will send us the list of documents i expect. So basically i am trying to find out what to expect when filing under this category. Are there any caveats, good to knows etc?
PS- I am also an Indian citizen but i will obviously piggy back on her application since my PD is not current.

I've filed for the I-140 with EB-1 category in business, then additional evidence was requested and finally received a denial. I would like to know:
1. What are the chances to get approved after appealing? Depends on why it was denied
2. If I were to appeal can I present new evidence? yes you should, else why would you even appeal??
3. After filing the appeal, how long should I expect to receive an answer from DC office? should take atleast 4 months
4. If I ask for additional time before appealing, what are the chances that the additional time will be approved?
5. Is it better to appeal or to request a motion to reopen whenever I gather the new info to defend my case?
6. Do I have better chances if I skip both appealing and motion to reopen and focus on re filing a new case?Depends on why it was denied

Hello,
I would need to apply for transit visa to fly through UK. There is a UK consulate office in ATLANTA but not sure if they would give transit visa if I go in person there? Did anyone had any experience.
