I-130 does play a role, when applying for visitors visa. but that doesnt disquialify anyone from getting visa. you have to show string ties to your country and provide enough evidence that you will come back. there are cases where they hv granted 10yrs multple visas !!

In the last few days there is little news/action about STRIVE act. When this act was proposed all of us got excited and promised to each other to do everything to make it a success. Some of us did make phone calls to lawmakers (as per IV directions) but after that everything seems cooled down. Why are we losing our focus now?
Yes the new Senate bill S.1035 (tightening H1B program) might have put some doubts in our minds; but can we continue our efforts on STRIVE and deal with S.1035 thru amendments when it comes to discussion. Discussion about S.1035 on our forum is fine and in fact we might have to do that to figure out how bad/good it is our specific issues. But in the meantime we have to continue our efforts on STRIVE act too.

The next step was to schedule a meeting with our lawmakers. Many people are doing that. Did you try doing that?
In addition, today President Bush renewed call for immigration reform. Things will happen before the Summer break.

I understand the 180 days rule after filing 485. what if the eb3(140 approved) based 485 has been pending for 180 days, and a newly approved eb2 140 has just been ported to the pending 485.
Is there a rule that the 180 days started over again after porting, since it's a new 140, which implys the applicant intends to work for the 140 position for a period of time.
What are the risks if the applicant changes the job right after eb2 140 gets approved, and changed the underlining 140 of the pending 485 from eb3 to the newly approved eb2.
Any comments are really appriciated.

i have a quick question for gurus here..
if an earlier original EB3 I-140 is revoked and if EB2 labor is approved now, can the PD be ported while filing new EB2 I-140 provided EB3 I-485 is pending??

i am in same situation. i applied for employment base in Dec 2004 and family based in May 2006 through my sister. Rightnow i'm on EAD and my sister based F4 category have priority Dec 2001.
You can apply in both category. when i was filing 485 (EB3), there is question if any other 485 petition is pending? The answer is "NO" even i have applied (I-130) under Family based GC. My lawyer said filing I-130 (for family based GC) is not consider as another petition (485) for GC. So it is ok to apply in both.

Hello,
My I-485 application was filed under EB3 category when I was working for my previous employer (PD - October 2006). I changed my job in August 2008, but never sent any documentation for AC21. I now have close to 8 years of experience and also a masters degree (MBA) from a reputed univeristy here in the US.
Now that EB2 dates are so close to October 2006, is there anyway I can port my application from EB3 to EB2? I can initiate this discussion with my current employer and may be able to convince them to help me. But I want to know exactly what needs to be done.

Since you are using the AC21, your job must be in the same or similar category. It does not matter how much qualification/experience you have. The job requirement should need that. Since you are using AC21, there is no way you can port from EB3 to EB2 in the current job. If you want to go for EB2, you need to start from scratch and the job requirement really needs a masters.
