My attorney says he cannot promise June 1 filing b'cos of volume...but not to worry b'cos date is current the entire month of June. Is that true? Does FIFO matter?

If, you have an approved EB3 and I-140 for a particular position from the same employer, and you file an EB-2 via PERM for the same employer, then there is a possibility of an audit and the first approved Lc on EB-3 rescinded. You, can however take your 5 years of experience and then file EB-2 for a different employer via PERM, provided your first employer does not withdraw your approved EB-3 I-140 petition. So my advise is get the best possible advice from the best lawyer and tread with caution.

I have seen that same tendency on ,when I asked about that, I was told that once your PD is current the RD plays the final role, if my RD is before someones with a 2004 PD then mine is done first. Now the service guy was the one telling me that. Question is how much can we believe them. Obviously we are getting mixed info here.
Lets just hope we all get it soon and this confusion they are causing with all the mixed messages is over soon!

I don't mean to be pessimistic regarding your application, but it seems that USCIS is processing old PDs 2003 and 2004 without looking at RD ( if it is within the published processing time or not). so if you have a PD of 2004 or older, don't worry about your RD and they will touch yours soon, assuming I-140 already approved. but if you have a PD newer than 2004, it might be a while before they get to those even if your RD is before 06/08/07 (published)
Also regarding the service request. I did a SR back in February to get an update of my case and they asked me to wait 45 days to hear something. I called again today ( 60 days later) and it seems that SR I did disapeared ( I even have a reference #). Customer Service rep said they can start a new SR but not sure if it is gonna do anything. they will get to the application when they can. and right now they are precessing 2003 and 2004.

I agree with you that this isn't just fair to people who are stuck in DOL. People who have been waiting for years together will continue waiting while people who got their PERM approved as recently as this year will file for 485. Where is the justice in this? I guess DOS & USCIS have not clue what they are doing as far as the PD's are considered. Couple of months back they had retrogressed as far as 2001 (EB3) & 2003 (EB2) and now they have all become current. How can this possibly happen?
Few of my friends purchased pre-approved labors paying thousands of dollars (which I don't approve anyways) and now they feel cheated having wasted the money for nothing.
I am happy that at least the recent applicants do not have to go through the ordeal which most of the members of IV had to deal with for few years now. My sincere hope is that they value their GC as much as people who have been stuck in this backlogs. It would be a very ungrateful of them, if they think that getting GC's is a piece of cake and it can be obtained in a year. I hope & pray that PD remains current for few more months so that people stuck in DOL have an opportunity to file their 485's soon.

We would have had another thread here blasting the inefficiency and unfairness of USCIS.

But then most consulting companies will not hire H1B's because it won't be cost effective.
Anyway just by checking most of this consulting firms businesses they will be able to uncover all the fraud.
It's very unethical to make you lie on your resume and then try to market you to an employer with fake experience, also nobody has responded to my comment. Real Companies like PWC, IBM pay you while you're on bench, while
this indian consulting companies break the law by not doing that.
I have seen tons of American citizen resumes with Fake experience. When we conducted background check, we found that a lot of companies they listed on thier resumes could not be found as their employer and a lot of people also fake on education saying they are from Harward etc..... This has become very common now locally. A lot of American people get JOBS ONLY through recomendations of friends or relatives and by word of mouth. They do not go through a stringent interview process. They will do everything possible to keep their jobs and get jobs in an easy manner. The companies that hire people on h1b as employees or contractors actually look for "real" skilled workers so that they have a strong skill based workers.
Body shops want you to fake ur resume only when
(1) You want to get your wife a h1b placement through a body shop, who actually has no experience but you approach the body shop for filing ur spouse h1b
(2) You do Master's and want to get a placement through a body shop.
(3) Your skills are not marketable by body shopping requirements.
Body shops care for themselves. The kind of consulting jobs they deal with are jobs that require wierd skills and most times and thats why they get those requirements.
You can survive without faking resume if
(1) Keep trying hard for direct jobs and meet minimum standards
(2) Be competitive, try to crack the googles and microsofts multi layer interviews, go back to basics and learn and work hard
(3) If you are subject to cap - work around it. Look for options.
(4) Increase your skill base. Do projects at home on your laptop. Go to open source or google user groups and gain more knowledge.
Make a body shopper dependent on your skills. Get selected for a contract job without faking resume and then carry your body shopper to sign the corp to corp contract. You can keep your skill and update as well as do body shopping without faking resume.
So if you blame body shopping companies for the mess, it will directly feed into anti immigrants as they want reasons to get back into their lazy easy job lifestyle and get rid of the competitive H1bs.

What do I make out of this? U think once assigned to an officer thgs shud start moving? Or...even after getting assigned to an IO thgs can go bad? Has any thing of that sort also happened? Just curious so I can be prepared...

Just back from an Infopass appointment.
The lady was friendly and chked the status of my application. First she informed me that it was under review and then she told me that on Aug 3, it was assigned to an IO. I didn't ask any further questions as the news that my case has been assigned to an officer made me happy. I just wished her a good day and left.
Now, I'm beginning to wonder if I shud have asked more questions such as about Namecheck, FP etc...But I donno its with an IO and I guess I'll know the actual status shortly.

since there are duplicate threads ..I will post here too ..efile on april 24 -- no EAD so far ..card prod email on june 24 ..I called USCIS and the lady told me that she will open a sevice request ..wonder what that does ?

Hi All,
I just got mail from my employer and atorney stating my perm got approved and they received the approval notice. There was no aduit and it was EB2 filed on 02/07/2008.
Still I would take steps as planned for others. I understand the pain of waiting without reason. I will update you guys about discussion with Mr.Gotcher tomorrow.
