    Took an infopass to find out why my spouse's case was not approved. A rude IO told that the background check was not completed yet, and it would take 30-60 days. Asked us to wait for 30-60 days. She looked and talked rude, so I did not ask her "if the background check was started or not". So, the question is how to expedite the background process, so that it will be cleared.

    So you guys are saying that because you are on a H1B you are working harder than others? Let me tell you that working hard does not guarantee your job. I have seen hard workers laid off left and right, be it US citizens, green card holders or H1Bs. In fact one of my GC friends said that it is a constant fear for him to be employed at all times, he was unemployed for 10 months after the dot com bust. That changed him completely, he said what will I do with my GC, can I feed my kids with a GC? I need a job. So it is everyone's perspective. I look at him and say at least you have a GC, he says at least you have a job. :)

    Probably most of you are aware of these things. So, let me say this advice is for newbies in the job. Lay-offs are done for business reasons and cost considerations. An American friend of mine lost his managerial job after 18 years of loyalty and experience. Company did not see the reason to continue to be in that business and the entire division related to the business was laid off. So working hard is good. Definitely a deserved trait. Do it for self-satisfaction, but not out of fear of loosing the job. At the same time, we should not be cloistered within the company working long hours. There are other things imprtant in life apart from the eight hours we spend at the office. I tend to my hobbies to keep my sanity after work. I look out for business indicators/news regarding how my company is doing. Good financial planning mandates savings around 6-12 months of living expenses which would lessen the impact of lay-off.;)

    What makes you think you qualify for EB1? Is it because you were planning to apply in OR category? or because you wanted to apply in EA category?

    FYI, a fresh PhD has very little chance to make it in EA category, and OR is applicable only for a researcher position.

    It's nice to create a big fuss about your qualifications and how you have been hurt, but at the end of the day, these were choices YOU made (i.e. taking up full-time PhD instead of going to work immediately after school). Also, as someone else said on one of these never ending threads, there is nothing that prevented your future employer applying for GC for a future job for you as soon as you finish PhD :-)

    So, again, if you are so qualified, and happy to live the consequences of your decision, where is the PLIGHT?

    ..."who were qualified for EB2 but applied in EB3. " ...Exactly my point. Technically I am qualified for EB1 but filed as EB2, hence i need to play by the rules governing EB2. Now if i begin lamenting that I am qualified for EB1 which is current and life is unfair since i am in EB2, how much sense would that make? My point is Don't crib if EB3 is retrogressed...use the system and become EB2, port your priority date, which is ofcourse dependent upon finding an EB2 job !!! All of this nonsense .."i pray someone does something for EB3" is going to get no one anywhere !! Fight for comprehensive immigration reform or HR 5882 recapture BUT for god's sake Do not blame the EB2 - India people who have played by the rules and are in a favorable position today relative to EB3 !!

    The lawsuit against PD porting makes sense from an EB2 perspective and they are right to go ahead with it. Porting your PD from EB3 to EB2 makes sense from an EB3 perspective and every EB3 should try to do it before this door closes, if it does.

    Let us list our the reasons for not complaining

    If you are on a H1B

    - Employer is withholding pay for 4-8 pay periods and leaving the employer would lead to losing the money
    - DOL and USCIS will not be able to recover all the money the employer owes per the employment agreement even if it reported. They might only recover the $$ mentioned on LCA
    - Employer does not run paychecks periodically so it might be hard to find Jobs and do a sucessful transfer of H1B visa and start the Greencard process all over again

    I485 filed cases

    - Employer withholds documentation and/or does not share documentation related to Labor/140 etc to be able to utilize AC21
    - The Job description that was communicated to the employee while filing the Labor does not match the employee's field of work and the employee has not reviewed the LC prior to signing

    Anything else?

    I think the idea is that we need to sell ourselves. I was the other day debating on www.cio.com and believe me, that was a tough exchange. Several US IT pros (mid management, engineering, etc) arguing that they are highly qualified and got laid off and cannot find a high paying job anymore. I had to sell myself and argue that our skills are needed, etc. I believe that we are still needed in this country and it is not all that easy to find "good" IT professionals. That's why we are here. However, I am very concious about the number of folks who Americans are willing to let in without hurting them.

    "Demand" and "right" will work up to the point in which we don't irate Americans. America has been sympathetic to immigrants in good part thanks to the capacity that America has to accomodate us here. If an excessive number of immigrants get in and that alarm citizens, I can tell you this country will become as unsympathetic to immigrants as many European countries are.

    LogicLife is doing a good thing by being so positive. Let's continue to sell our skills in a professional manner. Just be careful with the idea of "demanding" and "rights" though :)

    I still think that GC is not a right. It is a privilege, as is a driving license. You have to pass the drivers test to get a license. Logiclife's message from centuries back about anyone being able to move to another country does not work in today's world. There were no visit visas needed to get to India or China for example in those years, but why is it a requirement to have a visa to visit India now? Things have changed.

    BTW, I do think we should do what we can to improve the immigration process, but if nothing gets done its not the end of the world. We can "ask", "request" Congress to change laws. But surely you are not saying we "demand" for our rights to have a GC?

    can you please explain??........i thought france is a developed country with almost same opportunities as USA??

    if someone from somalia.....goes through this ordeal its understandable.....

    People choose to come here for plenty of different reasons: professional, economical, family or a combination of everything.
    Yes, France is a developed and rich country and, if I had stayed there, I would certainly be today in a much better situation, professionaly and financially!
    So, I certainly did not come here for the $$. It is extremely simple: it was just my childhood dream to live here and I am proud today that I made it.
    Yes, I had to go through that ordeal and I did not "choose" to do it, it just happened. I was just stuck in that infernal situation.
    Would I do it again, even to fulfill my dream? Certainly not, I am not that mad. Will it prove worth it eventually? I don't know yet.
    The truth of the matter is: how do you know in advance what lies ahead?
    If we always knew, life would be too easy, don't you think so?
    Nobody would make mistakes or wrong choices.
    So, was I right or wrong to go through all this? Well, again, I don't know.
    Time will tell...

    I totally agree with you. I think we should call DOS/USCIS to complain about this. I will ask as many as EB2s to do the same.
